CORRECTIONAL FACILITY VIOLENCE AND VICTIMIZATION

1.1 Correctional Practices and responses to correctional facility violence and victimization

Correctional practices and responses to correctional facility violence and victimization have always been debatable in the criminal justice system. There are multi-dimensional aspects of correctional practices and their respective responses are meant to reduce criminal activities. However, some practices correctional practices give reverse impact on the proportionate reduction of crimes, reason that the law enforcement agencies relevant officials do not ensure sincere efforts in the provision of adequate facilities and correctional facilities, in violation of policy instructions (Bell, 2002). Following correctional facilities, but not limited to, are necessarily used as measures for reduction of crime rates.

Provision of adequate health facilities-

In order to ensure corrective facilities, it is pertinent that prisoners are provided with adequate health and recreational facilities so that they can be made more responsible citizens.

Psychological training

Through properly trained psychological experts, the criminal mindset can be converted into a well civilized and well-learned mindset. Further, abnormal behavior may also be normalized by the provision of adequate training and facilities.

Educating and awareness

Education and proper awareness is the key to bring reforms in prisoners settings. Educating criminals resultantly ensures that the rate of crimes is considerably reduced.

Assessment of risk

Assessment of risk is also an important factor to be considered while developing a correctional facility. Wherein, the nature of the risk involved in each sort of crimes is properly assessed and addressed accordingly ( Fuller Orsagh, 1977).

1.2 Crime data and trends in correctional facility violence and victimization

Empirical data reveals that interpersonal assaults, homicides, suicides, robbery and other crimes have not been controlled to a considerable figure. Rather, it has been revealed through empirical research that correctional facilities are not practiced effectively to prevent crimes and to educate criminals in the reduction of crimes.

1.3 Future approaches to limiting correctional facility violence and victimization

In order to avoid further enhancement of violence and limiting the effects of crimes, it is pertinent law enforcement agencies need to ensure correctional facilities that aim massive awareness and well being of prisoners to educate them to be responsible citizens. Further, jails officials need to be trained with relevant training for ensuring the provision of requisite training. Moreover, it is also pertinent that diversely skilled prisoners need to be identified, and their skills to be utilized effectively for productive outcome in the correctional setting (Maltz, M. D. 1999).

1.4 Identification and discussion of sources of police injustice related to correctional facility violence and victimization.

Police and other prison officials have been involved in different sort of injustices related to correctional facility violence and victimization. Prisoners are not provided with adequate facilities keeping into consideration health and correctional setting standards, thereby paving the way for further violence and victimization of prisoners. Such behaviors resultantly lead to injustices related to correctional facilities. Moreover, policies, as well as other concerned authorities, show recklessness and rudeness in the rendering of their services that resultantly multiply crimes rate together with paving way for further deterioration of the criminal justice system. Police and other relevant officials need to be conscious enough in the provision of correctional measures.

2. Conclusion

After analyzing and assessing the correctional facility violence and victimization it is concluded that correctional facilities need to be addressed properly by reducing police injustices together with the provision of adequate care for prisoners in prisoners settings. Moreover, enough resources need to utilized to ensure effective corrective facilities for prevention of crimes violence and victimization. Timely addressing of issues will ensure the reduction in crimes rate leading to the welfare society.

Federal Emergency Management is one of the well-known agencies in the United States. Its primary purpose is to coordinate the responses of local as well as state authorities in the case of any disaster. History shows that the federal government has been playing an important role in emergency management. There are hundreds of incidents that have been managed by Federal Emergency Management since the time of its foundation. No doubt this agency helps in resolving the issues as well as assist in coping with the challenges of any natural disaster. Though all the incidents are managed by following the federal emergency management principles, but unfortunately, there are some incidents which cast hazardous impacts on the United States since 2010.

One of the main incidents, operated by Federal Emergency Management is Hurricane Harvey that cast hazardous impacts on the United States in Texas. According to the records, with nearly 4.5 feet of rain and wind at 130 mph, Hurricane Harvey propelled a disaster response. It was the time, when not only government and non-profit organizations came on the front foot to save lives but also neighbors joined to mount an untiring effort for meeting needs of thousands of people (Van Oldenborgh,et,al,2017). Before the storm landed near Rockport, on Aug 25, Federal Emergency Management Agency beforehand prepositioned personnel and supplies in this state. FEMA joined local agencies and all other organizations for showing a response against the devastation caused by this storm.

Hurricane Harvey caused destruction at great level but FEMA managed all the disasters effectively by acting upon its principles. FEMA catered disasters and responded to the threats by following its fundamental principles i.e. mitigation, preparedness, response, and recovery. Most of the time, things as per the plan and principles and add a lot in the success of FEMA. It assigned 28 Urban Search and Rescue teams to deploy to Texas for assisting state as well as local agencies for saving lives (Jonkman,et,al,2018). These teams rescued 6453 humans and 237 animals using high water trucks and boats. This rescue operation involved National Park Service, U.S. Fish and Wildlife Service and many other agencies. Huge funding was done by FEMA for the cost of protective measures and removal of debris. It also coordinated with National Business Emergency Operations Center calls among 150 companies that are working in the private sector.

There has been witnessed a historic need of housing following Hurricane Harvey, keeping the need in consideration, FEMA along with the state of Texas looked forward for making an agreement on establishing a state-managed mission and this is how the state of Texas provided homes to thousands of people on the behalf of FEMA. Due to the absence of grant-making authority, this agreement was created and it provided solutions that met disaster-specific objectives and also at the same time, FEMA developed more systematic long-term recovery plans. FEMA was already dealing with 692 open disasters (Goldberg,et,al,2018). FEMA deployed its Corps team (total 41 in numbers) that was prepared in 15 days of disaster declaration that started on 27 August. Hurricane Harvey stalled over parts in southern Texas, which resulted in flooding and weather conditions and it proved helpful as ports, roads and airports were closed and access to disastrous areas was prevented. Following Hurricane Harvey, the commodity was managed by Texas National Guard.

FEMA took an eye on the distribution efforts by taking help of Texas crisis management software platform for viewing the distribution points, inventory, commodity burn rates and required locations. The Environmental Protection Agency collaborated with Texas Commission on Environmental Quality and completed a target of 625 assessments of drinking water along with 441 wastewater assessments. The Department of Energy provided support to the Texas Division of Emergency Management. It was seen that utility companies made a proper response in a coordinated manner for activating mutual support networks. They assigned more than 10,000 workers who belonged to different 21 states for recovery and response efforts.

Department of Defense provided support to more than 30 missions on the behalf of FEMA. These mission assignments included strategic airlifts, rescue team, evacuation, transportation, logistics, patient movement, and installations support. The Department of Agriculture activated the program for providing food benefits to the households that would not even qualify. Schools in the areas that struck with Hurricane Harvey allowed providing meals free of cost for all the students. Helicopters were used for identifying stranded livestock. FEMA also supported the Department of Transportation that begins with the idea of reshaping and returning transportation infrastructure into its pre-storm conditions. Federal Highway Administration focused upon activating the employee response effort and staff assisted in emergencies. Many of the people lost their jobs because of the Hurricane Harvey and FEMA activated Disaster Unemployment Assistance for citizens of Texas, the commission was formed by FEMA that processed insurance claims of 136,576 out of 17,714 people under the name of the program "DUA".

So as a whole, it could be concluded that FEMA managed many disasters that caused destruction at a great level. FEMA through the collaboration of many government and non-government organizations supported various fields for resolving the issues. Programs were made not only for identifying the issues but also recovery programs of FEMA severed best for reshaping infrastructure and bringing back life of people on the normal routine. FEMA managed to handle many natural disasters because it has been dealing with numbers of unpredictable situations. National Response Framework and National Incident Management have almost same kind of principles like that of FEMA so they all supported each other for saving thousands of lives.

Legislative branch

Part 1

House of Representatives holds the power of impeaching government officials and serves as prosecutors. Impeachment trials can only be conducted by the senate, which, gives the right of serving as a jury. This gives the senate authority of hiring federal officials and even presidents. It also holds the power of rejected the appointees made by the president. This indicates that House is lacking any authority to challenge the appointed personnel. President can nominate public ministers and ambassadors with advice and consent of the senate. The power of House and Senate can be equated in terms of legislative process. Senate has power of making changes to the treaty by winning two-third of majority CITATION Sen191 \l 1033 (Senatte, 2019). House has the power of punishing each member and also deciding procedures for the punishments. They can also decide the expulsion of any member. Senate is more powerful in terms of blocking legislations because it can use filibuster CITATION Con192 \l 1033 (Congress, 2019). Compared to that, House has the authority of judging elections, returns and conduct evaluations of its own members. The comparison depicts the both House and Senate have implicit powers which are not stated in the constitution.

Part 2

The members of Congress represent their constituents and people. They hold hearings and develop a voting legislation. They spend hours in meeting with the people for knowing their concerns and demands. The members assure that they interact with the people and succeed in determining the ground level problems. People of each district can reach the member of Congress in their constituent for presenting issues. Members must be available to public and help them in dealing with difficulties. Members explain thee basic representations, difficulties and need of the people. They keep in tough with the people and consider their views.

Unit 5: The Judicial Branch Project

In the US, the federal court system is categorized into three categories (Cross 1457). These categories are District Court, Circuit Court, and the Supreme Court.

The Supreme Court interprets federal law, not state laws. Federal cases involve questions of state law interpretation but the resolution that is made based upon resolution as would have been made by the state. For federal laws and regulations, the district court will hear the case and appeals are made to the federal circuit courts while the Supreme Court will act as a reviewing court (Caldeira 1109). Supreme Court is the final conciliator of the question of constitutionality. Supreme Court only acts in concrete controversies and does not have a responding function. This means that the Supreme Court only goes into action in connection with concrete cases that make it to the Supreme Court, and decides those cases. But their decisions will have ramifications for similar cases or cases with similar legal questions posed.

The district courts are also known as the general trial courts. The district Court comprises of at least one district judge. The Judge is selected by the president of the US. However, they are confirmed by the Senate for a life long term (Mishkin 157). Both civil and criminal trials under federal jurisdiction are handled by district courts. It is the responsibility of the district court judges to not only manage the courts but also administering the employees of the court. District courts assign some of their tasks to federal magistrates that are appointed by the majority of votes given by the judges of district courts (Currie 1). They serve for eight years if they are working full time but serve for only four years if they work part-time. Unlike the Supreme Court, the decisions made by the district courts regarding a case can be challenged in the circuit and the Supreme Court respectively.

Cases that are decided by a federal court can be appealed in the circuit courts. Each court consists of multiple judges and is appointed by the president of the US and confirmed by the Senate. Unlike district court judges, circuit court judges are appointed for life. Unlike the Supreme Court where there is no need to hear an appeal, circuit court judges first hear the appeal and then will re-schedule the oral argument. Typically, in an oral argument, attorneys come and answer the questions of the judges. Unlike, Supreme Court, the decisions made by the circuit courts regarding a case can be challenged in the Supreme Court (Segal 158).

You need to tell your children that what exactly the real world looks like

Introduction

Self-esteem has a significant role to play in the personal growth of a child. Although, at very early ages children learn about "self," at pre-schools they are able to realize the "self-concept (Textbook, p. 501). It helps the children in evaluating themselves. At this stage, children are able to judge themselves on the basis of the good or bad concept. Therefore, the concept of Self-esteem is an overall evaluation of self in terms of positive or negative self (Textbook, p. 501). There are several contributing factors that make a child realize about self.

In her article, Diller (2011) is making a point that there is a significant role of society in developing the self-esteem of a child. It is agreeable that rewarding your child for nothing does not build his or her self-esteem; instead, it makes it difficult to live in the real world.

Discussion

Parents-child relationship is such a gentle and passionate that parents want all the comfort of world for their children. Regardless of their status, every parent tries his or her best to fulfill all the needs and desires of their children. In the long run, they forget about the development of esteem in their child. They forget about the real world that it does not always offer the best for the people. Therefore, it is essential for children to learn about it during their developmental phase. At the same time, it is the duty of the parents to tell their children about all the realities.

Likewise, the writer has quoted in the article about new sports ‘policy for children in Canada. She has made a notable point that too much protection of children is not good always. What is the logic of giving a trophy to the children for losing a match? It reflects the insecurities of society regarding the kids. The concept of "win or lose" and "pass or fail' are fitted in the societal notions. Over-protective policies and programs do not allow the children to build self-esteem on the basis of the norms and values of the society. How would a child will learn about winning and losing when both are treated equally? Life is very different from the images which parents show their children, being over-protective.

The obsession and possessiveness of parents impact the self-esteem of their children. Over-protective parents get into conflicts with the teachers of their children. They over-praise the kids, but they forget that these kids are going to face the real world when they are grown up (Driller, 2011, n.p). The self-concept does not remain the same, and it changes with the age and experience (Textbook, p. 303). It is essential to develop a self-esteem of their children by giving them an exposure to the real world.

Children need real-life lessons instead of trophies. Driller (2011) has highlighted outstanding experiences in her article that every parent should read it and try to guide their children accordingly. A time will come when parents will not be there to protect their children anymore. A child as a grown-up adult will have to face it on the basis of his or her experience. Therefore, parents and teachers should make a habit of telling children about their weaknesses.

Conclusion

In conclusion, self-esteem plays a more significant role in developing the personality of individuals. It is transformed with the age and real-life experiences. Sometimes, the overprotectiveness of parents cause problems for the children to build their self-esteem. Therefore, parents should guide children about real-life experiences rather than comforting them with a lie. It is better to award a child with life lessons instead of trophies or awards. Being over-protective does not give positive results in all cases.

It means that the city which defines my geographic background is the government’s center while a huge number of companies such as multinational oil companies, foreign embassies, international aid organizations, and many other financial institutions are based here. This can also be beneficial for me because Luanda is also one of the busiest seaports while connecting my country to other developed countries and regions of the world. Luanda has been founded by Paulo Dias in 1576 which became an administrative center of the Portuguese colony if Angola in the year of 1627. By religious affiliation and connection, I am affiliated with the religion or my religion is Cristian-Catholic. The region where I live is mainly covered by Christianity. Based on my personal view and view of our religious personalities, the Cristian-Catholic is a great religion that shapes the life of the followers in a peaceful manner. The Cristian-Catholic is an important religion that stems from the life, teachings, and death of Jesus which is broadly known as Christianity. Cristian-Catholic is the largest of the three main branches of the Christianity in the region. Additionally, in terms of the relation of Roman and Catholicism, every Roman Catholic is Christian but not every Christian is Roman Catholic.

Personal or Family Idiosyncrasies

Several habits and peculiarities are there to be seen in the black African which differentiates then from the rest. But the most appreciated personal and family idiosyncrasies of them are their behaviors towards an individual. It means that they can be found positively behaving to everyone around them. Another thing that makes us and almost our entire society of black Africans especially those living in Luanda can be found strong reactors to any of the injustice practices while preferring to be showing peculiarity in some particular situations.

Introduction

The approach of PE is known as a growing trend in the field of engineering. It is interesting to explore the concept of PE and how it is associated with different forms of considerations. It is worthy to mention that the phenomenon of PE can effectively identify through the perspectives of the client, employer, and the individual characterized as a PE. The idea of PE is related to the domain of professional engineering. It is vital to get licensed by completing a college degree and work under a professional engineer for at least four years. The basic requirement of this professional domain is to pass two competency exams and get a license of PE from the license board of the respective states. Here the main focus is to critically analyze the whole perspective of PE to differentiate between a good PE and not a very good PE.

Discussion

Undoubtedly, PE is recognized as the symbol of honor that assures the necessary skills and potential attained by the individual. It is a matter of respect that gives distinction to the individual from others. It is vital to determine how can be ranked as a good PE. This form of identification eventually helps to figure out the difference between a good PE and not a very good PE. It is critical to illustrate the perspective of professional PE is closely linked with different factors. Professional engineers have the authority to properly prepare, sign and seal, and submit all the potential engineering plans to meet the targets of public and private clients.

Conclusion

To conclude the discussion about the difference between a good and not a very good PE, it is worthy to indicate that quality and ethics are the basic standards that help to identify the difference. Holding high ethical standards of practice ensure the better form of excellent professional engineers as compared to not very good PE. The authority of the PE seal can only achieve by the good PE who have the potential to utilize their high competency and skills in an effective way.

A Tale of Five Classrooms

A classroom is a basic unit of the institute from where an individual learns all his or her initial skills and knowledge, and explores the new horizons of learning. A classroom may vary in shapes, sizes, structure, designing, and décor as per the level of the students and the infrastructure of the institute. Some institutes accommodate big classrooms, whereas other encourage smaller rooms as classes so that the number of students can be kept minimal in order to give individual attention to each student. The environment, structure, design, shape, and decor of the classroom, all play a significant role in the learning patterns of the students and assist in enhancing or diminishing the learning capability of the pupils (Bundick et al., 2014).

I remember when I was in Montessori, my school had medium-sized classrooms with a corner dedicated to the activities. Although small toys and props were always there in the classroom and students were allowed after regular intervals to play with, but there was a separate time slot dedicated primarily for the activities to build up the cognitive and motor skills. These activities included building sand structures, writing alphabets in sand, playing with play dough, flower arrangements, hand washing, use of different articles in the room, hair brushing, etc. The walls were painted with bright, attractive colors, each wall of varying color and had posters and pictures of various kinds including alphabets, animals, shapes, numbers, etc.

I thoroughly enjoyed being in my classroom, and it helped me greatly in learning new concepts at every stage. As far as I have learned about the classroom structures, I found my classroom to be a combination of classroom E, C, and D ("A Tale of Five Classrooms," 2019. Moreover, I personally feel that a classroom designed as per the strategies of classroom design E, the students will be more able to grasp the knowledge and more [properly able to fulfill the learning objectives.

Usage of the Internet and Productivity

Introduction

These days, the internet has become a powerful when it comes to making sure that how it tends to aid as far as the provision of the information is concerned. It also provides the user with an interface and a medium through which they are able to make sure that they can submit the information in a timely manner. Keeping this aspect in mind, it is pertinent to understand that what sort of impact internet is likely to have when it comes to evaluation of the job performance. The given article tends to discuss the same premises, it looks at how the usage of the internet contributes towards the productivity at the workplace and what are some of the broader concerns that are needed to be kept in mind in this regard. In this paper, the given article is going to be discussed, specially the way statistical and empirical information is provided. It would also be seen what some of the broader changes are that are witnessed in the organization as the given changes are implemented. The other thing that is going to be looked at is that what is the readability of the article and what are some of the finer points that are discussed during the course of the article (Castellacci & Viñas-Bardolet, 2019).

Readability and the Quality of the Writing

The reading starts well as it tends to point out both side of the arguments and the attention and the interest of the reader is grabbed from the first moment. The other thing that is being done here is that it has been made sure that the extant research points are being provided in a very clear and precise manner (Castellacci & Viñas-Bardolet, 2019). Thus, as far as the readability goes, the narration has started quite well. The other thing that is being done is that it has been made sure that whatever the ideas that are discussed during the course of the reading are discussed and brought about in a very interesting manner. What it means is that effort is being made to make sure that each of the respective reading section is setup in the manner that allows the user to make sure that they are developing enough insight with regards to the way the whole idea of the workplace productivity and the usage of the internet is supposed to be linked. Keeping that aspect in mind, the other thing that has to be noted is that how the theory and the hypothesis are supposed to be setup. Here, there is a clear effort on the part of the writer to make sure that they are able to point out the exact nature of the relationship that exists among men and women at the given point of time (Castellacci & Viñas-Bardolet, 2019). At times, there is information overload with regards to the way some of the statistical barometers are discussed during the course of the paper, but it can be seen that the readability and the interest of the user is sorted out in quite an appropriate manner. Whenever there is any piece of narration, the important thing that has to be done is to make sure that the right sort of balance has to be achieved with regards to providing the theoretical information as well as making sure that the underlying technical aspects and the interest of the reader is needed to be taken care off.

Scientific Methodology

At times, there is an impression among people that in order to ensure that something is made more interesting, there is an effort by the writer to make sure that they water down some of the finer points that are needed to be presented during the course of the reading. In this case though, that is not being done as all the corresponding hypothesis, the way they are being tested, the underlying relationship that exists among the variables is closely followed. At the same time, the variables are clearly defined and how they linkage among all the variables, specifically the workload, the productivity of the employee and the amount of time they tend to use on the internet are all being defined in a very precise manner. Keeping this aspect in mind, the corresponding scientific methodologies are discussed quite well during the course of the paper. The only thing that could have been improved was the literature review was something that was needed to be added (Castellacci & Viñas-Bardolet, 2019).

Conclusion

In the hindsight, it can be said that the article and the reading present some key information with regards to the amount of time the people tend to internet, and how it eventually relates with their level of the productivity. It has to be noted that during the course of the reading, there are many instances that are discussed that how the usage of the internet is bound to affect the productivity at the workplace and different ideologies are being presented. The research from some of the other authors and an alternative point of view though would have made it a much more credible source of information. he paper has investigated the channels through which the use of Internet for professional purposes affects job satisfaction. The empirical results of the study provide support for this idea, and confirm the set of specific hypotheses that we have developed on the moderating effects of Internet use. To begin with, two variables play a crucial role according to our results: employees' education level and their occupational category. Both of these variables turn out to be central in our analysis, since they have a threefold impact on job satisfaction.

Analysis of the USA Patriot Act

Introduction

The Patriot Act is legislation promulgated in 2001 to enhance the competency of law enforcement in the United States to deter and detect terrorism. Its official title reads as Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism. The provisions of the Patriot Act were revisited in 2015. However, several aspects of the act remain contentious in nature. Primarily, the Patriot Act is an extension of the instruments that were utilized against organized crime and drug dealers. The local law enforcement agencies played an instrumental role to enforce the act in true letter and spirits.

Discussion

The Judges could authorize the act by permitting the federal agents to use wiretaps to track a certain suspect. Each government agency plays a dominant role in the enforcement of the act. One of the most fundamental aspects is enhancing the intelligence and information sharing between the government agencies. Moreover, the state plays it part by abrogating specific statutes and legislation which limits the implications for crimes related to terror. A wide range of researchers argues that it desecrates the fundamental constitutional rights of American citizens. Since the government exercised the privilege and authority to spy on the citizens without their consent and enhance the risk for the ordinary citizen to become accused of a crime, section 215 was revisited. It is critical to highlight the manifestations of section 215 of the Act ADDIN ZOTERO_ITEM CSL_CITATION {"citationID":"a2g4ams43tn","properties":{"formattedCitation":"(Domke, Graham, Coe, John, & Coopman, 2006)","plainCitation":"(Domke, Graham, Coe, John, & Coopman, 2006)"},"citationItems":[{"id":"jmWtTeWl/awHrVoEh","uris":["http://zotero.org/users/local/H8YOvGFC/items/DEBQE5BX"],"uri":["http://zotero.org/users/local/H8YOvGFC/items/DEBQE5BX"],"itemData":{"id":"jmWtTeWl/awHrVoEh","type":"article-journal","title":"Going Public as Political Strategy: The Bush Administration, an Echoing Press, and Passage of the Patriot Act","container-title":"Political Communication","page":"291-312","volume":"23","issue":"3","source":"Taylor and Francis+NEJM","abstract":"Research suggests that political elites excel at controlling political and media information environments, particularly in times of national crisis, such as the events and aftermath of September 11. This study examines the creation and passage of the Patriot Act, which was proposed by the Bush administration following the terrorist attacks and quickly passed with strong support by the U.S. Congress. We argue that (a) the public communications of the Bush administration, particularly those by George W. Bush and John Ashcroft, and (b) news coverage about the legislation were instrumental in this outcome. Public communications by Bush and Ashcroft and news coverage about the Act were content analyzed to identify the timing of the messages and the themes and perspectives emphasized, and congressional debates and activities were examined for insight into their relation with administration and press discourse. Findings suggest that Bush and Ashcroft's communications, in combination with a press that largely echoed the administration's messages, created an environment in which Congress faced significant pressure to pass the legislation with remarkable speed.","DOI":"10.1080/10584600600808844","ISSN":"1058-4609","shortTitle":"Going Public as Political Strategy","author":[{"family":"Domke","given":"David"},{"family":"Graham","given":"Erica S."},{"family":"Coe","given":"Kevin"},{"family":"John","given":"Sue Lockett"},{"family":"Coopman","given":"Ted"}],"issued":{"date-parts":[["2006",9,1]]}}}],"schema":"https://github.com/citation-style-language/schema/raw/master/csl-citation.json"} (Domke, Graham, Coe, John, & Coopman, 2006).

Section 215 essentially violates the constitution in several ways. Above all, the Fourth Amendment prevents every authority or government to permit a search without the acquisition of a warrant and have a probable cause to believe the person to be a criminal. Meanwhile, the First Amendment's provision of free speech also gets violated. The government is already privileged to exercise authority. The Act enables the government to investigate the suspect but at the cost of the very fundamental right of the citizens' right to freedom and privacy. The agencies responsible for enforcing the Act are often criticized and suspected for exploiting and misusing the government resources and funds. The primary intentions of the federal authorities are unsure of utilizing the information which raises concerns for the government's power and autonomy.

The states ought not to have the same authority to display and sponsor the contentious symbols of having radical messages affiliated with them. It may sound a petty matter. However, the significance of these controversial symbols is of paramount importance in light of the 1sta and 14th Amendments.

Impact on Organizations and Businesses

The manifestations of the act are not only confined to expanded surveillance ventures. The cross border activities of the financial institution are critically examined under the framework of Title III statute. The security paradigms of the organizations are also further enhanced under the influence of the Act. For instance, the intricate privacy elements and observation of the organizations by the government agencies with the aim to abrogate the laundering activities prove productive for several organizations.

The citizens possess the very right to harness their privacy and security under the 1st Amendment (Phillips, C. M. (2017)). The Act is a potential source to preserve and protect the security of the citizens from harmful elements. Essentially, the security paradigms of the citizens are protected and similar impacts are observed in the vast framework of organizations. The context of the security environment changed in the United States after the detrimental incident of 9/11. The Patriot Act is the leading development directed at strengthening the security paradigms of the state. The multinational and small organizations were used previously by the terrorist elements. The enforcement of the Act by the government and agencies has prominently reduced the adverse implications for these organizations related to the security metrics.

A Critical Appraisal:

The Patriot Act is one of the major developments made in the United States after the incident of 9/11 to strengthen the privacy, security and elimination of the terror elements. There existed several contentious statutes in the Act as section 215. Irrefutably, the right to freedom, speech and privacy of the citizens were surely compromised under the functioning of the Patriot Act. The local law enforcement agencies exercised the right to intervene and spy the citizens which were deemed the suspect ADDIN ZOTERO_ITEM CSL_CITATION {"citationID":"a24uvrhrreh","properties":{"formattedCitation":"(Mell, 2002)","plainCitation":"(Mell, 2002)"},"citationItems":[{"id":1340,"uris":["http://zotero.org/users/local/ccgWoSRn/items/ZHLAPNAM"],"uri":["http://zotero.org/users/local/ccgWoSRn/items/ZHLAPNAM"],"itemData":{"id":1340,"type":"article-journal","title":"Big Brother at the Door: Balancing National Security with Privacy under the USA Patriot Act","container-title":"Denver University Law Review","page":"375","volume":"80","shortTitle":"Big Brother at the Door","journalAbbreviation":"Denv. The constitution incorporated the provisions which were promulgated by the government and several stakeholders became a part in the process.

Each citizen of the United States is independent to exercise the right to speech and privacy. There exist instances which are critical and exceptions and restrictions can be observed in the law to prevent the citizens from perpetuating violence. The Act caused the organizations to operate in a secure environment by enhancing security paradigms.

Conclusion:

The Patriot Act of the United States of America (USA) has played an instrumental role to reduce the terroristic activities in the states. The major feature of the Act was following a strict model of privacy and authorizing the local agencies to enforce the provisions in a productive manner. However, the citizens expressed grave concerns upon violation of their privacy. They were deprived of their right under the 1st Amendment. The Patriot Act casts a crucial impact on the organizational security metrics as well.

Visentin and Scarpi (2012) uncover the formal contract mechanism required for the business. The buyer and seller cannot start a business until they bind through a formal contract. The article explains that the partner must be capable of automating the management and address the problems encountered in the process. It explains the business-to-business relationship between the parties is dependent on the contract. Social and economic factors are considered before entering into a legal binding. The intentions of the parties are influenced by the meditator. Trust and satisfaction are of relative importance in upgrading to a contract.

The article explains that dissatisfaction between parties causes discrepancy and impacts the contract. It highlights the need for voluntary positive commitment from both parties in case of B2B. social and economic factors are of significance in assessing the contract and relationship between parties. Relational identification impacts the nature of the contract. It is dependent on the satisfaction and commitment from both parties. Changes in satisfaction or loyalty challenge the validity of the contract.

The research is relevant to the current case study because it provides a theoretical background for the formation of a contract between buyer and seller and its impacts on the business. It highlights main elements of a contract such as an offer and acceptance without which the parties cannot enter into a legal binding. The source will be used for evaluating the nature of the contract between Fine Wine Imports and Kingston Family Vineyards. The elements of the contract will be used for examining does placing an order and agreement from Fine Wine creates a legal binding or not. This will also be used for assessing the validity of the terms and conditions of Kingston Vineyards. The source will also be used to evaluate how the contract works in business-to-business relationships.

The source provides information about the risk of loss associated with the online contract established between buyer and seller. It explains that internet-based consumer perceptions have a significant impact on the mediating role and the nature of the relationship. Shopper's trust is of great importance in the contracts that are established online. It explains that the buyer is liable to claim for the financial loss even after delivery of the order. The consumer has already perceived financial risk involved during making an online purchase. Trust factor also influences the buyer's intentions of purchasing the product through an online platform. Seller's policy on selling products also affects the nature of the contract and identifies which party bears the loss. The article provides brief details about the situations and conditions that might lead to a loss for the buyer. The conditions like failure to deliver functional product are also identified that will prove the negligence from the seller's side. It also highlights the need for considering perceived financial risk from the consumer's side before making a purchase.

The current source is linked to the case study because it provides analysis of the online business that will be used for determining the party that is liable for hearing the loss. The risk of loss between Fine Wine Imports and Kingston Family Vineyards will be evaluated by considering the contents of this article. It will be used for examining the impact of terms of sales and bill of landing on the risks of loss claimed by the buyer. The policy of the seller like money back guarantee or liability for claiming damages will also be used for determining the wrongdoer. The source will be used for identifying how perceptions about financial risk might have affected the claims made by the defendant.

The source is used for evaluating the conditions that make tort liability applicable in case of the injured employee. It provides brief details about the compensations that the employee will receive in case of injuries such as insurance and damages. The article also highlights the party that is responsible for paying damages to the injured employee. Changing liability will not affect injury or wages. The source makes use of the theory of risk and wage adjustments for identifying the right compensation that the employee would receive. Cost avoiding theory is also utilized for explaining the cause of tort liability. It also states that it is difficult to identify the injuries in case of online business.

This source will be used for evaluating which party will be responsible for paying for the damages suffered by the injured employee. Theoretical risks and wage adjustments provide a theoretical framework for dealing with the case. It will be utilized for identifying that party that is responsible for causing injury to the truck driver.

Contracts exist in different forms in the business world. There are many conflicts that have resulted from the fact that people do not have knowledge of the rules they have to follow when getting into a contract. This scholarly article concentrates on the manner in which law has enabled people to avoid the many cases they have always encountered in the past. The existence of good laws enables people to have a clear way with which they are supposed to engage in business. The article also addresses different common laws that are used in day to day business.

The relevance of this article is of great importance in this field of study. The article clearly brings out the aspects that must always be addressed in any contract. Since this field of study majorly concentrates on what makes contracts to be abiding, it is a great resource to be used in solving the conflicts that business people experience from time to time. Conflict and contract law spell out the procedures and elements that contracts should follow. To ascertain whether the mistake that resulted in a conflict is a responsibility of the buyer or the seller, conflict and contract law must be put into practice.

2. Carter JW. (1988). Contract law. Journal of contract law

To understand the nature of contracts better, Carter comes up with a journal that mainly consists of the major conflicts that people experience. From time to time, business people always get into conflicts that might not be easy to solve without the knowledge of contract law. Before each of them signs the contract, they always need to understand the rules of the country in question. Specifically, they need to be conversant with contract law to avoid such conflicts. The journal has different cases that directly relate to this course. The journal is compiled by Carter though it has worked from different scholars. With relative examples, the journal educates on contracts and the law that is used in the process of contracts.

To this course and assignment, the journal has a lot of relevance. The journal rotates around contract law which is the major topic tackled by this course. It lists the elements of a contract and the manner in which they are protected by law. It is easy to apply the knowledge from this journal to different situations that affect people when doing business. The article is directly related to this course. This course looks at the manner in which supplies should be done. A process is a contract that is governed by laws and in case one of the parties in the contract does not abide by the laws then it becomes easy to penalize them. The article can be used as resource material, in this case, to relate to the cases that affect contracts in life. The article can also be used to get different case studies that show how business people can break the laws that govern business contracts without knowing.

To get the meaning of a contract, this journal goes ahead to look at the basic elements that should be present in a contract. With the journal, one can easily get how contracts should be done and why many people fail to honor the contracts that they get into. The author separates the different elements that make up a contract and the manner in which they should be related. This course mainly deals with supplies management. One needs basic knowledge of contracts and how they should always be done. It is through studying the nature of a contract that one can solve conflicts that affect business people once they get into such contracts. Business people always hire professionals to get into such contracts on their behalf. To be able to handle such a position, one must know the different laws they are expected to follow.

The article is an excerpt from the journal of conflicts and contract law. The topic directly relates to supplies management. One must learn such laws before they can get into contracts that involve the supply of different types of products. The article directly connects with this topic and assignment and it clearly shows why it is a great resource for this assignment.

As a resource used in supplies management, it clearly provides procedures that should be followed in case of any contract. The major challenge that business people always face is the fact that they do not always have an idea of the rules and laws that govern contracts. By looking at what is in the journal, one can clearly point out the laws that always affect contracts. There are various academic articles that talk about different aspects of contracts and conflicts that affect such contracts.

The journal is of great relevance in this topic as it clearly spells out the different laws that should be followed by anyone who wants to get into any form of business contract. Supplies are contracts between a supplier and a buyer. The journal, therefore, provides important information that can be used to know how the contracts work.

CASE STUDY

This is a case of mistakes made during a contract. The case presents different ways in which business people can break the contracts that they get into. Fine Wines makes an order of the wines that they need from overseas. They make the order through an online platform and make the payments through the Miami Trust Bank. In a contract, it is necessary to have a third party (necessarily a bank) that can withhold the payments for some time until the buyer confirms receipt of the good in good condition.

The contract mainly involves two parties who later have conflicts after mistakes are made by different parties involved in the contract. The first mistake that occurs in the contract is the fact that the supplier goes ahead to sign the contract without confirming the terms and conditions of the contract. The second mistake that occurred in this contract is the fact that a wrong account number was provided for the payment of the wines ordered by the company. This is not a mistake from either the bank or the buyer since they did not provide the account number to be used for payments.

There are other mistakes that took place during the contract and can only be understood by putting into practice the laws that govern contracts. To understand the contract better it is better to break it into the following parts:

Contract formation

Before any transaction is done, the first step is always to contract formation. Both parties have to agree with the quality of goods as well as the prices. In this case, there was a contract because both parties signed and agreed to engage in business. Although the seller did not read the terms and conditions of the contract, it remains a contract because he went ahead to agree with the terms of the contract. Once he has agreed with the uniform commercial code, he had no option but to stick with whatever the rules will state (Bonell, 2018).

In the contract, there was an offer of $15000 made by the buyer. The seller clearly noticed this offer and agreed to it. This is what makes it a binding contract between the two parties. Once one party presents an offer for business and the other party makes an acceptance, it becomes a contract and will follow the universal commercial code. There was involvement of a third party to oversee the payments. The law requires that in any contract, there should exist at least one party that is non-partisan to any of the parties involved in the contract. The party (usually a bank or any financial institution with a good reputation) is expected to withhold the money until the buyer receives the purchased goods. The third party is expected to release the money only when the buyer confirms that the goods have reached the agreed destination.

In this contract, the third party was the Miami Trust Bank that was to make the payments once Fine Wines Imports confirmed receipt of the goods at the port. Under Article 4A of the universal commercial code, it is important to have an intermediary bank to help with the payments. This is well taken care of by the presence of the bank in the contract.

Under article 1 on the definitions of a contract, this is one that becomes a full contract with all the elements that a contract should have.

Another important element of a contract is the intention to create a legal relationship. This implies that both parties agree to operate within the law. In this contract, the seller agreed to abide by the universal commercial code when he signed the offer that was sent to him by the buyer. Another key element of a contract that is evident in this contract is a consideration that has been made. The buyer promised to pay $15000 for the wines once they reach the port. All these reasons make this a valid contract that must operate within the laws that govern sales and purchases from state to state.

Risk of loss

The risk of loss, in this case, involves three companies. The seller, the buyer and the company involved in the freight. The loss was incurred because the wine was delivered to the wrong warehouse. Both the seller and the buyer made clear instructions that the wine was supposed to be delivered to warehouse E. when Southern Shipping made the delivery to warehouse B, they made a mistake and they should, therefore, bear the value of the loss. It is their mistake that resulted in the loss that occurred (JW, 1988).

Article 7 that deals with the bills of lading define the role of each party when goods are in transit, in the warehouse and until they are picked up by the buyer. The article states that it is the duty of the freight company to ensure that the goods are delivered in the state in which they left the seller. Any loss incurred during the freight is solely on the freight company. It also defines the role of the freight company once the goods reach the warehouse. The company should inform the seller that the goods have been delivered so that the seller can send an invoice to the buyer who then clears the payment.

It is also the duty of the shipping company to ensure that the goods are delivered to the desired warehouse. Failure to which any losses that might occur as a result of the mix up will be paid by the shipping company. In this regard, the loss of the wine will be paid by the shipping company.

Tort liability

Once the wine went bad, it was the duty of US customs to ensure it was removed from the warehouse. During the movement, an employee got injured and is also planning a lawsuit against the responsible company. The employee does not in any way have a contract with the US customs, Fine Wines Imports or even Kingson Family Vineyards. The employee only has a contract with Sunshine State Movers. The employer is responsible and will ensure all the employees against such accidents (McMohan, 2018).

The legal theory that can be used in this case is the one that governs employer-employee relations. The employment law deals with the rights of employees within an employment contract. The employee shall be compensated in case of infection or injuries when performing their duties. The company contracted to move the wine from the warehouse should, therefore, pay the employee because the accident occurred when he or she was on duty.

“DUE” Date Vs “DO” Date

“Due” date Vs “Do” date

“Due” date Vs “Do” date

In the context of an assignment, "Due' date is the date in which an assignment must be turned in. On the other hand, "Do" date can be defined from the time an assignment was assigned until the time it is to be submitted. Typically, "Due" date is firm and absolute which if missed, can result in a penalty. While the objective of "Do" date is to get something done in a specific amount of time to meet the "Due" date. The "Do" date helps a student in planning and collecting the data that is required to complete an assignment on time. This also includes time management strategies that are required to meet the designated deadline. It is recommended that in the "Do" time a student must break the assignment into several parts so that they can spend more time on the difficult part and less on the easy part of an assignment.

The Six Pillars of Character helps a lot in understanding the responsibility that one has when he or she is assigned with any task ("The Six Pillars of Character," n.d.). I will teach my future students to abide by the "Due" and "Do" date by explaining to them the importance of both the dates. Furthermore, I will tell them the penalty if they are unable to abide by the "Due date so that they can take it seriously. I will tell them that they can review the given assignment in the "Do" date so that in case of any ambiguities they can discuss it before. Additionally, I will tell them to discuss the questions in the class, so that the students who are not confident enough to ask questions can also get benefit from the discussion, and can complete the assignment within time. I will also tell them the importance of time management so that they can also divide their assignment according to the time assigned to abide by the "Due" date.

Black History Month

Around 1926 many former slaves were still living in America; it was a reminder for an institution that was banned some 50 years before. Having said that there were many black colleges and other institutions that were forming and where the black people were getting their basic education. Along with that black artists were creating songs and participating and also black leaders were trying their hard to change the view of the world and of Americans specifically about the perception of blacks and how they were being treated in the American history. Carter G. Woodson was born in Virginia to former slaves wanted to account for all the injustice that was being done to the entire black community. He was also the only black person who had a doctorate from Harvard University. Right after returning from Harvard university Woodson started his professional life to gather the early history of black Americans who were entirely overlooked, ignored and also suppressed by the early historians who played significant roles in writing the history of America and also the teachers who then used these history books.

To Woodson, the black experience was quite significant simply to be put into a small group of academics. In the struggle of racial uplift, Woodson understood that his part was to use both black history and the associated culture as a tool. So this month originally started as Negro history week in 1926. It was intentionally put in the second week of February so that it can coincide with the birthday of Frederick Douglass and Abraham Lincoln ADDIN ZOTERO_ITEM CSL_CITATION {"citationID":"LJVPkQCV","properties":{"formattedCitation":"(\\uc0\\u8220{}Knowing the Past Opens the Door to the Future The Continuing Importance of Black History Month\\uc0\\u8221{})","plainCitation":"(“Knowing the Past Opens the Door to the Future The Continuing Importance of Black History Month”)","noteIndex":0},"citationItems":[{"id":942,"uris":["http://zotero.org/users/local/4C6u8dIT/items/RCEG4SYF"],"uri":["http://zotero.org/users/local/4C6u8dIT/items/RCEG4SYF"],"itemData":{"id":942,"type":"webpage","title":"Knowing the Past Opens the Door to the Future The Continuing Importance of Black History Month","container-title":"National Museum of African American History and Culture","abstract":"No one has played a greater role in helping all Americans know the black past than Carter G. In 1976 the then President Gerald R.Ford extended this one week into whole month by saying that the entire nation is required to seize the opportunity to honor the ignored deeds of black Americans in every part of attempt throughout our history. Basically, black history month started to attain the recognition from a stubborn nation of the invaluable role that black people have played in the freedom of the United States of America. It is very important to recognize the Black History month as African American history month because in the freedom of America these black people also played quite a significant role. In the revolutionary war as well the Black people sacrificed their lives to get freedom from the invaders. Another reason why America should recognize this day is to show solidarity and respect towards the black Americans, by doing this they will also get the idea that they are not outsiders who are living on their soil forcefully, but they are equal citizens of American society. By doing this, these black people who are otherwise outrageous will play their role in the development of the country as one nation ADDIN ZOTERO_ITEM CSL_CITATION {"citationID":"EeOtrAmG","properties":{"formattedCitation":"(Ernie Suggs)","plainCitation":"(Ernie Suggs)","noteIndex":0},"citationItems":[{"id":940,"uris":["http://zotero.org/users/local/4C6u8dIT/items/32KP32LA"],"uri":["http://zotero.org/users/local/4C6u8dIT/items/32KP32LA"],"itemData":{"id":940,"type":"webpage","title":"29 reasons to celebrate Black History Month, No. 1: Carter Woodson","container-title":"ajc","abstract":"Only the second black person to earn a doctorate at Harvard University, Carter Woodson devoted his professional life to gathering the history of African Americans who \"were overlooked, ignored, and even suppressed by the writers of history textbooks and the teachers who use them.\"","URL":"https://www.ajc.com/lifestyles/reasons-celebrate-black-history-month-carter-woodson/hqVCPDeZoUbnzJ9NbmDZDO/","shortTitle":"29 reasons to celebrate Black History Month, No. 1","language":"English","author":[{"family":"Ernie Suggs","given":"The Atlanta Journal-Constitution"}],"accessed":{"date-parts":[["2019",3,18]]}}}],"schema":"https://github.com/citation-style-language/schema/raw/master/csl-citation.json"} (Ernie Suggs).

Although this date is celebrated occasionally and mostly, it is used to accomplish the political agendas. Most of the racists who are still present in American society refuse to accept and acknowledge the role of African Americans. Majority of Black Americans are still working so hard to have their basic rights, and by celebrating this day as African American day they will be confident that the nation has accepted them as the citizens of America but still they are facing discrimination in every field, so it is quite difficult to have a unanimous decision on this. It is the responsibility of the government to announce this day as the day of American African, but that is also a difficult thing to do because with the Trump administration in power who himself is racist such policy and such recognitions are impossible to envision at this hour.

Boarders Of Communications In China

Boarders of Communications In China

(1/4 page down from top)

(1/2 page down from top)

Internet access has influenced many people around the globe, and it has developed communication among people. Having access to internet means that, people can connect to internet through different technological devices such as mobile phones, computers, and other devices; and they also have access to internet services such as email, and social media platforms. Internet has its pros and cons while starting a discussion with big countries and restrictions on internet, there comes only one superpower country; China. The government of China limits its citizens to use internet by blocking the usage of some websites and it is also monitoring internet accessibility of individuals. This paper will also include a discussion about the impacts of limitations of internet access on the business sector, people and its citizens.

Internet Access

Internet access is the accessibility of internet to people who have technology and are willing to pay for internet services. People have been using technology with internet access for years for their development, to gather information about current affairs, and to promote their business. Internet has changed people and their societies by letting them adopt new trends and patterns that are beneficial. People have transformed their living standards and lifestyles with the help of the latest technological tool ‘internet.” This allows people to access information, interact with other people and to connect with other market segments in this global world. Interactions are important to grow and develop, while, communication gap may lead to misinterpretations and misperceptions about each other whether it is on micro levels or macro levels. Foundation of internet can be marked to 1969 when military personnel was allowed to have access to each other and share information by the US Department of Defense. For this purpose, the department introduced ARPAnet. Internet accessibility, on the other hand, has allowed people to have information by making its availability on web content in the shape of websites, news sources, and social media platforms.

Internet accessibility has helped people to change their lifestyles and living standards, which means that they have developed and many people around the globe are still developing. Internet access and development can be related in a way that, they have started communicating with each other, people have started their online businesses, and they are still using this internet source to promote their concerns of backgrounds and geography. Accessibility of the internet has strengthened people in the 21st century, which can be considered as a well-matched to them with internet accessibility. This access to internet has also allowed socializing, while it depends on people whether they socialize with people on community levels or global levels. This internet accessibility has helped people to develop and grow indeed but unfortunately, it has made a huge impact on people and their nations in a negative way. It is noteworthy to highlight the destruction made by the internet.

People using internet have been engaged with the internet and technological devices. They allow these internet tools and technological devices to have access to their information. While having access to information that is available on the internet, people allow these technological devices to have access to their personal information. This can be termed as the business of information without being aware of privacy risks, that are being threatened by this accessibility. People are not aware of these privacy risks; therefore, they allow these technological devices and the internet to have access to their activities. This internet has controlled the lives of people in these last few decades, while half the population using this, are still unaware of this control. Personal information is shared within the organizations, activities are being monitored, more importantly, this has changed behavioral patterns of people towards each other. But the main question is about who controls the media? To have an answer, it is important to know about networked authoritarianism, while it is the controls over internet access and control on the internet.

Internet authoritarianism is the process of limiting internet access by authoritarians which may be the government and agencies which are working for the development and policy-making of the countries . People are limited to use internet and internet sources like China has limited its citizens from using social media platforms and other content available on the internet.

With emerging trend of internet trend, it does not only threats personal privacy of people but it is threatening policymakers, governments, and organizations. These are threatened in a way that their internal organizational plans and policies are accessed without asking to have access to their information. There are several anonymous people and organization who are involved in such activities which are against cybersecurity. While cybersecurity ensures privacy of people about their activities and their information which is saved in their mobile phones or other technological devices.

Adding more, to avoid these threats, organizations, and governments make policies regarding limitations on internet availability. One of the drawbacks of the internet is that it has made everything public and anyone can have access to information on their fingertips. The concept of personal privacy has become very unpopular because of the internet. People have provided access to their privacy knowingly or unknowingly. When it comes to misuse of internet, it has also become a trend that has threatened people, societies, and their governments. Their private life activities are accessed by the internet sources, organizational and governmental secrets and their secret policies are also accessed. This is a threat because it risks the development of organizations and state institutions because they become limited regarding policy-making and their policies are publicized. Sometimes there are likely chances that it does not allows organizations to compete with other organizations and States because their policies are already publicized by accessing their information which is later made available online.

Internet Freedom and China

China has restricted its citizens to have access and to use internet according to their choices. There have been some issues that have threatened the state institutions by making their information publically available. China may be the best example of internet censorship regulations which have contributed to limitations on internet freedom. This is the country where there is communism, later which began to globalize with the other countries and regions in terms of technology. But, China has controlled its information technology and it has control over its media whether it is print media or traditional media. China has maintained a clear climate of limiting information technology and access to internet by its citizens. The limitation over internet and information technology is considered equal to restriction of enjoying human rights which include access to information, freedom of speech, and distribution of information with others.

The Chinese government has kept very tight policies to limit the freedom of new media, traditional media and internet accessibility. Government institutions have made strict plans and policies, therefore, they have started monitoring systems of organizations, individuals, and institutions. Any action leading to acting against government policies regarding information sharing and having access to banned content may lead jailing of individuals.

However, the constitution of China does not limit its citizens from freedom of speech, and media including print media and soft media. But, China cannot afford any threatening situation to the government and its institutions, exposing secrets that may endanger their security and state. Chinese government has initiated a program that requires internet ensures and organizations that also include international agencies and organizations working in China to sign a pledge which ensures internet sovereignty. For Chinese government, certain websites may harm their policies, and they are Facebook, WhatsApp, Twitter, and YouTube.

China has restricted information technology and having access to internet because it threatens its political and socio-economic policies. People are not allowed to share pictures videos and other content which may threat to their political stabilities. There are also some limitations on micro-blogging which shares content about corruption and this also includes rumors. These have made huge impact on people and other countries because they are limited to share and have access to information. People do not get the idea about what is happening around them and they are on the other hand limited to share information whether it is about their country, organizations and their social activities. Young generation is unaware of the internet world because many platforms are banned, they do not have options to socialize as other youth and generations do in other countries. Socializations through internet have helped people to develop by exploring new opportunities, and they have advanced their communication by interacting with other people. Allowing people of China to use information technology and internet may help them to know about western media and this will also encourage students to appear on websites like New York Times.

Impacts on Chinese Culture

The influence of media censorship in the region of China can be observed in the case of many different areas. It is observed that the Chinese government has strict regulations and restricted domains considering the use of different sites on the internet. It is noteworthy to mention that the government of China has strict compliance and restricted domain referring the access to various forms of media. The influence of the growing approach of restricted internet eventually appeared in the form of various concerns for the people of China. The major argument or concern in the case of limited media policy by China government appeared as its great influence on the culture of China.

The basic citizenship right of freedom of speech and press is greatly affected by the idea of restricted media policy in the country. Chinese people have limited chances to deliver their thoughts to others in an easy manner. The phenomenon of a one-party state made it eventually difficult for others to openly share their opinions. Media restricted policy is characterized as the immense oppression for the public of the country. It is also significant to indicate that the government of the country is immensely concerned to have proper scrutiny that what Chinese people read in English and it influences their thought process. This domain is categorized as a major reason for the controlling of media and other networking platforms by the government. It is established that change in the form of media access eventually appeared in the form of chronic change in the overall culture of the country. It is greatly argued that the restricted approach of using media hinders the creative approach of Chinese people. They eventually have a restricted form of knowledge that decreases their chances of understanding changing perspectives at a global level. The paradigm of censoring limits the country’s options to successfully involve in the international business scenario.

High-tech vs. lo tech

Low-tech focuses on making the technological design simple that is user-friendly. As the purpose is to provide enhanced learning opportunities to the students, so it is more appropriate to simply technology CITATION ABr08 \l 1033 (Brandon, Hirt, & Cameron, 2008). Low tech offers simple features compared to the high technology.

Resource dependent

The project depends on the resources provided by the investors that include the college funds. The shareholders have the primary responsibility for ensuring the provision of adequate funds for building technology.

Complex vs. simple

High technology is always problematic because the students are unable to understand its use. Also it takes more time to familiarize a larger population with advanced features. Simplifying technology is a cost-effective alternative. Simple techniques do not require huge investments.

Unique approaches

The approach focuses on building solution design: the team established the most adaptive architecture. Technology validation demands that the team ensures the project fulfills the business needs.

Scenario development

The modern dorms are created by using technology that emphasizes providing collaborative spaces for collaborating through high-technology tools. Scenario stresses on improving the customers' lifetime value, offering price flexibility and providing a competitive edge. The Hook Model is utilized because it assists users in resolving the underlying problem. The first component of the model is the trigger that calls for action and incited certain behavior in humans. It informs the user about what will happen next. The users encounter both internal and external triggers. The external triggers take instructions from the explicit instructions. External triggers work in the form of emails, websites, social sites, and other applications. Internal triggers are linked with the internal thoughts, feelings, and emotions of the users. Pre-existing routines of the users have a significant influence on the trigger. Emotions can be seen as internal triggers that are powerful enough to initiate an action CITATION Mer17 \l 1033 (Fong, 2017). The action is the next phase of the model that motivates the user to act. Some thoughts are working behind the initiation of an action. Three important things that initiate an action include motivation, the ability to complete the desired action and activating behavior. Rewarding reinforce the users by encouraging them to solve the problem. Rewards are categorized into three categories depending on the needs of an individual. The user considers the reward of the tribe when he feels the need of connecting with other people. This makes him feel socially valuable and inclusive. The reward for hunt stresses more on acquiring physical objects such as the need for money, food and other worldly things. These things are essential for one's survival. The reward for self depends on one's personal gratification. The user cares more about self and takes action that satisfies self CITATION RIK17 \l 1033 (DAM & SIANG, 2017).

A reward of the hunt: the need for fulfilling worldly desires

The first scenario exhibits the encounter of the user with a professional situation. In this scenario, the triggers are initiated by emails or websites. This motivated the user to respond to the email by composing an appropriate message. This is linked to the reward of the tribe because the individual develops the need of connecting to other people. The use of technology will thus allow the user to learn to work in a professional environment. In the personal scenario, an individual exhibits the feelings of excitement. Working with the ICT technologies makes him feel motivated revealing his sense of learning something new. This exhibits a sense of self because the actions taken by the user are for his own development. the third scenario includes both professional and personal development.

It is one of the political affairs, referring to the opulent politics that is in fashion ADDIN ZOTERO_ITEM CSL_CITATION {"citationID":"7xv2hKsL","properties":{"formattedCitation":"(Fleming 2019)","plainCitation":"(Fleming 2019)","noteIndex":0},"citationItems":[{"id":26,"uris":["http://zotero.org/users/local/6bWeQAmN/items/W2636R9D"],"uri":["http://zotero.org/users/local/6bWeQAmN/items/W2636R9D"],"itemData":{"id":26,"type":"article-journal","container-title":"Celebrity Studies","page":"1–12","source":"Google Scholar","title":"Because it’s the truth: authenticating Chanel through celebrity death and fan magazines","title-short":"Because it’s the truth","author":[{"family":"Fleming","given":"Ann-Marie"}],"issued":{"date-parts":[["2019"]]}}}],"schema":"https://github.com/citation-style-language/schema/raw/master/csl-citation.json"} (Fleming 2019). Other political factors are the Consumer protection laws referring to the barriers that can stop the competition of gaining any kind of profit that might be gained from some good or product. Privacy regulations laws are also one of the threat taking into account that there are several companies that are using the brand name to fulfill its negative aims in attracting the customers. One of the major aspects to note is the European Commission rules that are threatening NO 5 with the ban on sediment ingredients and the belaboring regulations, creating hurdles in the passage of the company to make up the mark and gain that trend setter title ADDIN ZOTERO_ITEM CSL_CITATION {"citationID":"FcKdaIoP","properties":{"formattedCitation":"(Zhang and Su 2019)","plainCitation":"(Zhang and Su 2019)","noteIndex":0},"citationItems":[{"id":29,"uris":["http://zotero.org/users/local/6bWeQAmN/items/R9WIKE4C"],"uri":["http://zotero.org/users/local/6bWeQAmN/items/R9WIKE4C"],"itemData":{"id":29,"type":"paper-conference","container-title":"2019 International Conference on Management, Education Technology and Economics (ICMETE 2019)","publisher":"Atlantis Press","source":"Google Scholar","title":"Analysis of the Effective Integration of Visual Communication Design and Brand Image","author":[{"family":"Zhang","given":"Li"},{"family":"Su","given":"Zhuan"}],"issued":{"date-parts":[["2019"]]}}}],"schema":"https://github.com/citation-style-language/schema/raw/master/csl-citation.json"} (Zhang and Su 2019).

Economic Factors

Economics is one of the major catch line in the analysis of the reputation of the company and in the progression of all the brands and the services that are provided to the consumer in the world. It is highlighted that there is a growing purchase power in the world which is a contribution as well as a tribute to the developing areas of the market. also, there are some worldwide economic crisis, that are also affecting Chanel from taking significant steps in the world. One of the important aspect to consider is, in 1974 there was a lack of availability of products based on the sales cut that caused the demand to rise, and it resulted in the increase in the sales as well as the price of the products. In addition, Luxury goods making is also something that is casting a direct impact on the economic factors such as, the number of customers has grown to triple in the under 20 years ranging to 330 million people. As the company's spending has risen to about 4 300 billion USD dollars since 2013 which is also one of the major factors that are affecting the company ADDIN ZOTERO_ITEM CSL_CITATION {"citationID":"faeDO8sP","properties":{"formattedCitation":"(Ashill, Semaan, and Williams 2019)","plainCitation":"(Ashill, Semaan, and Williams 2019)","noteIndex":0},"citationItems":[{"id":32,"uris":["http://zotero.org/users/local/6bWeQAmN/items/W6PD278Y"],"uri":["http://zotero.org/users/local/6bWeQAmN/items/W6PD278Y"],"itemData":{"id":32,"type":"paper-conference","container-title":"2018 Annual Meeting of the Decision Sciences Institute Proceedings","page":"1074–1093","source":"Google Scholar","title":"Measuring Brand Charisma: An Exploratory Study of Luxury Brand Consumers","title-short":"Measuring Brand Charisma","author":[{"family":"Ashill","given":"Nicholas"},{"family":"Semaan","given":"Rania W."},{"family":"Williams","given":"Paul"}],"issued":{"date-parts":[["2019"]]}}}],"schema":"https://github.com/citation-style-language/schema/raw/master/csl-citation.json"} (Ashill, Semaan, and Williams 2019).

Social factors

There are a lot of social factors that are affecting the progress of the company taking into account that these factors are casting a direct impact on the working of the company. one of the major social factors is the total Asian value prestige brand that is associated with Chanel because the number of sales is directly dependent on the number of the customer that is casting a direct impact on the brand. It is also important to note that exclusively in 1974, Wertheimer brothers reduced the overall sales from 18000 to about 120000 by removing all the products that are found in all the drug section Also, there is a high-profile image that is casting an impact on the promotion of the brand. It refers to the divert campaigns that are featured in some high caliber celebrities that can endorse the product or the overall worth that is associated with the product. Other social factors that are affecting the brand are the exclusivity of the products because the products are not available to the elite people who are either very rich or they are in direct contact with the boutique where such goods are prepared. Although, it is something very positive still this lack of access is also something that is casting a negative impact on the publicity of the brand paving the way for lack of customer ratio ADDIN ZOTERO_ITEM CSL_CITATION {"citationID":"Yc5Aj9mj","properties":{"formattedCitation":"(Fleming 2019)","plainCitation":"(Fleming 2019)","noteIndex":0},"citationItems":[{"id":26,"uris":["http://zotero.org/users/local/6bWeQAmN/items/W2636R9D"],"uri":["http://zotero.org/users/local/6bWeQAmN/items/W2636R9D"],"itemData":{"id":26,"type":"article-journal","container-title":"Celebrity Studies","page":"1–12","source":"Google Scholar","title":"Because it’s the truth: authenticating Chanel through celebrity death and fan magazines","title-short":"Because it’s the truth","author":[{"family":"Fleming","given":"Ann-Marie"}],"issued":{"date-parts":[["2019"]]}}}],"schema":"https://github.com/citation-style-language/schema/raw/master/csl-citation.json"} (Fleming 2019).

Technological factors

There are different technological factors that are affecting the overall working of the brand, taking into account the fact that branding is facilitated with the help of coherence o technology and the other electronic applications that are having a direct impact on the promotion of the brands. Also, it is highlighted that the emergence of mobile banking has played a central role in directing the customers to get in touch with the outlet and get the required product. Other technological factors are a move towards industrialization that highlighted that the approach of “re-formulation” that is used for shifting trend away from the synthetic chemicals. It is also highlighted that technological factors have paved the way for more online shopping avenues, facilitating the shopping of brands. It also encourages Chanel to be as much present on the social media as possible so that more customers can be attracted. This stance of having more sustainable products has paved the way for a synthetic chemical that is also a serious point to be considered. Also, Chanel has a very well-developed website that is acting as a profound source of customer attraction, highlighting feminist taglines that attract all types of women. However, it is also a threat as not all the customers have an access to the website and it is one of the major gaps in terms of the technological aspect. Empowering and asserting is also found controversial in some cultures, that might affect the brand ADDIN ZOTERO_ITEM CSL_CITATION {"citationID":"qOEOcZu2","properties":{"formattedCitation":"(Horoszko, Moskowitz, and Moskowitz 2018)","plainCitation":"(Horoszko, Moskowitz, and Moskowitz 2018)","noteIndex":0},"citationItems":[{"id":40,"uris":["http://zotero.org/users/local/6bWeQAmN/items/L3PFDPDR"],"uri":["http://zotero.org/users/local/6bWeQAmN/items/L3PFDPDR"],"itemData":{"id":40,"type":"chapter","container-title":"Understanding the Marketing Exceptionality of Prestige Perfumes","page":"19–25","publisher":"Routledge","source":"Google Scholar","title":"Introducing the notion of DNA for a perfume brand","author":[{"family":"Horoszko","given":"Nithda"},{"family":"Moskowitz","given":"David"},{"family":"Moskowitz","given":"Howard"}],"issued":{"date-parts":[["2018"]]}}}],"schema":"https://github.com/citation-style-language/schema/raw/master/csl-citation.json"} (Horoszko, Moskowitz, and Moskowitz 2018).

Among the economic factors, one of the most significant issues is that of increased purchase power in the world. It is highlighted that today, everyone knows about and eager about having the most luxury goods and it is posing serious competition for Chanel, taking into account the stance of majority availability and lack of innovation. People always prefer things that are more expensive. there is some prestige associated with the particular object rather than a casual approach that can make the produce more purchasable and a sign of prestige. Excessive availability is also counted in the aspect because already available products are given less importance ADDIN ZOTERO_ITEM CSL_CITATION {"citationID":"1hTC9Wx3","properties":{"formattedCitation":"(Fleming 2019)","plainCitation":"(Fleming 2019)","noteIndex":0},"citationItems":[{"id":26,"uris":["http://zotero.org/users/local/6bWeQAmN/items/W2636R9D"],"uri":["http://zotero.org/users/local/6bWeQAmN/items/W2636R9D"],"itemData":{"id":26,"type":"article-journal","container-title":"Celebrity Studies","page":"1–12","source":"Google Scholar","title":"Because it’s the truth: authenticating Chanel through celebrity death and fan magazines","title-short":"Because it’s the truth","author":[{"family":"Fleming","given":"Ann-Marie"}],"issued":{"date-parts":[["2019"]]}}}],"schema":"https://github.com/citation-style-language/schema/raw/master/csl-citation.json"} (Fleming 2019).
