The American system which is largely based on the system of check and balances had remained under wide critique for decades. The popular critics argue that the system of check and balance have made the system too constrained. Neither the opposition and nor the government has ever remained in a position to openly play against the opposite part. The system of checks and balances have remained crucial in maintaining the supremacy of law in the U.S, but it has come with some inherent drawbacks. These drawbacks have been criticized from time to time by the critiques, who consider that such a system of check and balances erodes the transparency and makes limit the American governance system to work. There are other reasons also argued by him, which suggests that the system of checks and balances have become obsolete. This suggests that the President was constrained, by the system of checks over him that he could not use his prerogative of the Veto power. Similarly, this political fashion goes over to the Congress who has also used it scarcely. This scarce use of the Veto power which exists in the hands of the President and rests with that of the Congress has been used very rarely. The next important thing which this system of checks and balances erode is the power of accusation of impeachment. There have been just three Presidents who have accused with the impeachment. In short, these are some reasons as to why the author has remained too critical about this system of checks and balances.
The system of the American federal government is designed in such a way that no law can be made while keeping it administratively independent of the other federal unit. For example, the legislature introduces the bill, it is then passed to the executive (the President), and finally, it can be tested by the people of the U.S, in the court. In doing so the roles of the political parties are undoubtedly controlled. For example, the anti-immigrant campaign hinted by President Trump during his election campaigns was curtailed by the U.S Supreme court, when it announced that this move by the President is of the political nature. This backlash by the U.S Supreme Court ruling conforms to that aspect of the quote where the writer mentions that the political parties are unable to rule.
The above critique on the American system of federalism appears much credible as the role of the Republican Party appears much controlled by the federal prerogatives which have been divided with other organs of the federal government. But an unbiased approach suggests that this system of American governance has with time inculcated some dysfunctional attributes. These dysfunctional attributes are what the author of the quote has based them as reasons. Irrespective of the political moves of the Republican Party, it is much evidence that the system of this check and balances have constrained the Presidential powers. The other case that can be considered in this regard is that of the JCPOA (the Join Comprehensive Plan of Actions). If such a move is targeted by the Democrats (who initially have worked over it), the Supreme Court and then the legislature can override any such move.
