TO THE HONORABLE JUDGE OF SAID COURT
COMES NOW Anheuser-Busch Companies, Inc., a defendant in the above cause, to file this answer to the original petition of Justin William King, plaintiff herein, and would respectfully show the Court as follows
ANSWER TO COUNT I NEGLIGENCE
Defendant admits the allegations in paragraphs 8 of the Complaint.
The allegations in paragraphs 9 in the Complaint are denied because the medical expenditures of plaintiff increased because of his own negligence. If he had not loosened wires placed in his jaws, he could have recovered earlier with lesser medical expenses.
Concerning paragraphs 6, the Defendant is without knowledge or information sufficient to
form a belief as to the truth of the allegations.
FIRST AFFIRMATIVE DEFENSE
Plaintiff failed to exercise ordinary care on his behalf about the incident alleged in plaintiffs complaint, in that, among other things, plaintiffs negligence towards security measure i.e., wearing a helmet and incorrect and misleading maneuver. According to the statement of plaintiff, he swayed his bike to let the truck past. He should have turned his bike to the right, instead of left. In that way, the accident and injury to both parties could have been avoided. Therefore, plaintiffs recovery, if any, from this defendant must be diminished in proportion to the amount of negligence attributable to plaintiff.
SECOND AFFIRMATIVE DEFENSE
Any damage plaintiff sustained was due to, or contributed to by, the acts of plaintiff, in that he assumed the risk in connection with the accident alleged to have given rise to the injuries by over speeding the truck full of cargo and then turning bike to the wrong side. Secondly, the plaintiff admitted to the loosening the wire placed in his jaws by hospital staff, to recover. Plaintiff had no medical knowledge but was aware of consequences. The irreparable damage and medical cost could have been avoided if plaintiff did not show negligence.
COUNTER-CLAIM
Answering the allegations contained in the complaint by way of counterclaim, defendant alleges
The defendant, Anheuser-Busch, suffered a total financial loss of 55,000 due to the accident which involved Justin King. The plaintiff had a duty to control his bike all the time and follow necessary security measures. The damage of 50,000 to truck and 5,000 of cargo loss was incurred due to the negligence of plaintiff. The accident occurred because the plaintiff was not wearing a helmet and exceeded the safe speed limit. The plaintiff, Mr. King, should have control of his bike all the time. He swerved the bike to the wrong side, and in such a condition, the driver of the truck was not able to avoid the accident. The loss of defendant should be deducted from the recovery of plaintiff, if any, considering that the plaintiff contributed to his own injury and the loss of defendant.

1. That the court enters judgment dismissing the complaint
2. That defendant has a judgment against plaintiff Justin William King of 55,000
The total amount is sum of damages of beer truck, 50,000, and cargo loss of 5,000.
The truck was initially worth 120,000, but immediately after the accident, its worth decreased to 70,000. Moreover, the defendant had lost an important client because the company was unable to complete the order.
