Analysis of Sleazy in Seattle

1) The legal ethical concern raised by the behavior of Bogle and Gates attorneys was the limitation on the scope of discovery in which they used misleading discovery responses to exclude two relevant smoking gun documents from Bogle adversaries despite indicating that all relevant documents had been produced (Taylor Jr 2). According to the case study, the plaintiffs lawyers had served Fisons Corp counsel with requests for production of documents including the production of genuine copies of any letters sent by your company to physicians concerning theophylline toxicity in children (6). However, after Bogle and Gates lawyers discovered the several Intal documents in 1987, the lawyers resolved that, under the discovery rules, they acted in good faith and had no affirmative obligation to produce the documents as the existing product scope of discovery did not include Intal files. The lawyers cited that all experienced trial lawyers do some ducking and dodging in reference to the discovery process and within the rationale of concealment, they were not obligated to provide the opposition with any document that they did not specifically and clearly ask for. However, in this case, the plaintiffs lawyers did specifically and clearly ask for the smoking gun documents. Additionally, Saltzburg indicates that Bogle lawyers actions were deliberately or recklessly false and intended to deceive (15).

2) Lawyers have a strict ethical responsibility to zealously advocate for their clients. Zealous representation means a lawyer should do everything reasonable to help a client to win a case based on what is reasonable in reference to the impact of the parties involved and what is achievable within the bounds of the law. However, zealous representation does not mean lawyers should win a case at all costs by engaging in illegal activities in order to protect the client and achieve the goals set at the beginning of the representation. Referencing the case study, the lawyers were not acting in good faith and their decision to withhold documents requested amounted to a corporate cover-up which is not defined by zealously advocate. Based on this notion, I do not agree with the experts as the behavior of the firm was inappropriate and unethical. Preferably, I agree with Washington State Supreme Courts interpretation as Bogle lawyers had an obligation to provide the smoking gun documents to the opposition. Additionally, the collusion not to reveal smoking gun documents to the adversaries amounted to the conspiracy to defeat justice. The lawyers had indicated that they had provided all relevant documents regarding the case which was a lie and was aimed at misleading the adversaries that there were no responsive documents to the requests. Furthermore, I agree with the Supreme Court interpretation because misleading the adversaries so as not to produce crucial documents which were important to the case amounted to dishonesty and possible fraud.

3) As Fisons Corp manager, I would have majorly focused on character excellence, honesty and cooperation values. A pharmaceutical company is general deals with the human body which is attributed to many ethical concerns. Therefore, character excellence will ensure the company engages in ethical operations which are not harmful to both the company and the general public. This will also ensure that the company attracts fewer lawsuits based on unethical operations. Additionally, honesty will ensure that all the users of our products are well informed of any defects of the using the drug. In this regard, I would make the maximum disclosure about the effects of our products and any discovery of the research on their effects. Subsequently, cooperation will ensure the company cooperates with all medical practitioners administering its drugs to ensure effective communication about dose prescription and administration. Lastly, being aware of the negative reaction Somophyllin Oral Liquid on patients with viral infection, I would publicize this information and ensure it is labeled on every packaging of the drug and every retailer or clinic administering the drug have a poster warning about the impacts of the drug on participants with viral infections. Also, I will settle any damages as instructed by the court and apologize on behalf of the company.
