Scenario 1
On December 2016 a 16 year old boy named James was caught stealing gold from a jewelry shop.
Steps in Criminal Justice Systems
Arrest
The police will make a record of the arrest. James has the right to remain silent and can ask for the lawyer.
Charges
After the arrest, the police will compile a written report and enlist the detail of the crime. This report contains all the information regarding crimes and witness statements if any. Prosecution
The prosecutor of a criminal defendant is responsible to decide to charge a person with a crime or not depending upon the evidence provided by police.
Court (Intake)
In the scenario mentioned above, a detention hearing will be held to ensure all the rights of juveniles are followed or not.
Disposition
The judge will decide the placement of James and whether the supervision is needed or not.
Sentencing
As James is accused of the theft he will be sent to the juvenile detention center because he is only 16.
If during the probation period James turns 18 and his probation period is not finished then he will automatically be sent to the adult criminal justice system. There he will again be charged with the theft and a proper trial will be done in which he can plead guilty or not guilty. If guilty, he will be sentenced according to the law of California State and will be sent to jail.
Scenario 2
On 4th December 2019, a 16-year-old boy named James was caught stealing gold from a jewelry shop. He was arrested by the police and the charges were filed against him. As he is 16 years old and the prosecutor will send him to the Juvenile detention center. From there he will be taken into court where the Judge will decide the suitable placement for him. As the age limit is increased he will remain in Juvenile detention center until he turns 18.
