Although the US Constitution has divided the power equally among all the three branches of the government; Executive, Legislative and Judicial branch. In reality, the case is different, sometimes one of the intuitions becomes more powerful and it tries to manipulate the law. Likewise, nowadays it is thought the government has become more powerful. According to a poll conducted by Gallup, 55 % of the people think that the federal government has got much of the power (Swift, 2017). The more powerful government can be a threat to judicial decisions in a country. As the constitution demands equal powers from each branch, the more power in one or two branches can be dangerous for the other. It would be problematic for the judicial branch to keep a check and balance on other branches of the government. At the same time, there will be limited access for the judiciary in order to influence policy decisions. Also, the fair decisions of the judicial branch will be influenced by the power of national government. For example, the current US President has controlled the foreign policy of the country.
Q2. Ans.
According to the US Constitution, the 12th amendment highlights that selection of the President and Vice President through the Electoral College elections. If I got a chance to amend the US Constitution, I would amend the 12th amendment and replace it with the direct election system in order to elect a President and Vice President of the country. As the Electoral College process ignores the popular vote in electing the President and vice president in the US. At the same time, the two-party system in the US also lacks to represent the decisions of minor races and ethnic groups in the United States (Giger, Rosset, & Bernauer, 2012). However, the slight amendment in the constitution for popular vote and the multi-party system would enhance the democracy in the country.
